    Below we provide an overview of how the mortgage process works in Spain for both residents and non-residents, including the most important steps and legal requirements.

    Residents and non-residents

    In Spain, both people who live there (residents) and people who do not live there (non-residents) can apply for a mortgage. The conditions, documents, and options differ slightly between these two groups:

    Residents

    Typically have access to higher loan-to-value ratios (up to 80% of market value).

    In some cases, they can take advantage of more favorable interest rates or longer terms.

    Must be able to demonstrate that they have permanent residence rights (if applicable).

    Non-residents

    You can apply for a mortgage in Spain, but banks often apply a lower loan-to-value ratio (usually up to 60–70% of the value of the property).

    Usually have stricter income requirements and require additional documentation.

    Must take into account other tax requirements (such as tax number and bank account in Spain).

    Required documents

    To apply for a Spanish mortgage, you will usually need to submit the following documents to the bank or mortgage advisor:

    For residents and non-residents

    Valid passport or ID card.

    NIE number (Número de Identificación de Extranjero): a tax identification number in Spain.

    Proof of income (e.g., pay slips, annual statement).

    Bank statements for the past few months.

    Employer's statement (if employed).

    For self-employed persons: profit and loss statement, tax returns.

    Copy of the purchase/construction contract (escritura or preliminary purchase agreement).

    Valuation of the property (appraisal by a certified appraiser).

    Step-by-step mortgage process in Spain

    Step 1. Orientation and financial check
    An independent mortgage advisor will assess your financial situation and discuss possible mortgage options. This includes calculating how much you can borrow and determining the best interest rate type.

    Step 2. Preliminary offer (Oferta vinculante)
    The bank provides a preliminary offer stating the mortgage terms, term, interest rate, and other costs. This offer is legally binding on the bank for a certain period of time.

    Step 3. Submit your mortgage application
    Together with your advisor, you submit the formal mortgage application, including all necessary documents.

    Step 4. Property valuation
    The bank will have the property valued by a certified appraiser to determine its market value. The mortgage will be based on this appraised value.

    Step 5. Acceptance and completion
    Once your mortgage application has been approved, you will receive the final mortgage agreement. This will be signed at the notary's office, together with the title deed (escritura).

    Step 6. Registration with the land registry
    The mortgage and ownership are registered with the Spanish Land Registry (Registro de la Propiedad). Only then is the mortgage fully legally valid.

    Spanish mortgage product types

    In Spain, there are various types of mortgages, including:

    Fixed interest rate (interest rate remains the same throughout the entire term).

    Variable interest rate (interest rate may change during the term).

    Partially fixed/variable interest rate (combination form).
